Welcome to HighStakeHealth! These Terms of Service ("Terms") govern your use of our mobile app, website, and services (collectively, the "Service"), designed to empower poker players worldwide. By accessing or using the Service, you agree to be bound by these Terms. If you disagree, please do not use the Service.

1. Your Responsibilities

You’re here to elevate your game, and we’re here to help. As a user, you agree to:

  • Use the Service in compliance with all applicable laws and regulations.
  • Provide accurate information during registration and keep your account details up to date.
  • Safeguard your account credentials—your edge starts with you. Don’t share your login with others.
  • Use the Service for personal, non-commercial purposes only, unless expressly permitted by us.

You’re responsible for your actions on the Service. Any misuse, including attempts to disrupt the platform or harm other users, may lead to immediate account termination.

2. Content Ownership and Usage

Your data is your power. When you sync biometric data (e.g., via Oura) or input personal insights, you grant HighStakeHealth a worldwide, non-exclusive, royalty-free license to use, process, and analyze this data to deliver personalized insights and improve the Service.

We own all intellectual property rights in the Service, including its design, code, and content (excluding user-generated data). You may not copy, modify, or distribute any part of the Service without our written consent. Our tools are built to give you an edge—respect the craft behind them.

3. Subscription and Payment

HighStakeHealth operates on a subscription model to fuel your success. By subscribing, you agree to:

  • Pay the fees outlined in your chosen plan, billed on a recurring basis.
  • Authorize automatic payments via your selected payment method. You’ll be notified of any price changes at least 30 days in advance.
  • Cancel anytime through your account settings—your subscription will remain active until the end of the billing cycle.

No refunds will be issued for partial billing periods, but we’re committed to ensuring you get value every step of the way.

4. Limitation of Liability

We’re all in to optimize your performance, but poker’s a game of risk—and so is life. To the fullest extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied.
  • HighStakeHealth, its affiliates, and partners aren’t liable for indirect, incidental, or consequential damages (e.g., lost earnings from poker games) arising from your use of the Service.
  • Our total liability to you won’t exceed the amount you paid us in the last 12 months—or $100 if you’re on a free tier.

We’ll do our best to keep the Service running smoothly, but we’re not responsible for interruptions beyond our control (e.g., internet outages or third-party API failures).

5. Account Termination

Your journey with HighStakeHealth is yours to control. You can terminate your account anytime via the app. We reserve the right to suspend or terminate your access if:

  • You violate these Terms or engage in fraudulent activity.
  • We suspect unauthorized use of your account.
  • We discontinue the Service (we’ll give you 30 days’ notice if possible).

Upon termination, your data may be deleted per our Privacy Policy. Your edge is yours—take it with you, but leave our tools behind.

6. Dispute Resolution

Let’s keep the table friendly. If a dispute arises:

  • Contact us first at chad@highstakehealth.com. We’ll aim to resolve it within 30 days.
  • If unresolved, disputes will be settled by binding arbitration in [Your Jurisdiction], under the rules of the [Arbitration Association]. No class actions—each player stands alone.
